Traveling by plane can sometimes turn into a real ordeal, especially in the event of significant delay. This is what Bruno experienced, whose flight was delayed by 8 hours. Despite this mishap, he managed to obtain a reimbursement of 2,000 euros, illustrating that it is possible to assert your rights as a passenger.
When a plane delay disrupts your plans #
Bruno, a forty-year-old living in the Paris suburbs, had booked a flight to Djerba. However, due to a strong plane delay more than 8 hours on the Paris-Djerba line, he was not able to enjoy his day as planned. “Instead of arriving around 3 p.m. in Djerba and enjoying the day, my family and I arrived, tired, around 11 p.m.,” he explains.
The flight initially scheduled for 11:45 a.m. finally took off at 7:45 p.m. This considerable delay had a major impact on the stay of Bruno and his family. They couldn’t even have dinner when they arrived because the hotel restaurants had closed. A frustrating situation, especially for a short stay of six nights including full board.
The process of obtaining compensation #
Faced with this situation, Bruno first amicably contacted his tour operator. He claimed to be only an intermediary between the customer and the suppliers. Determined to obtain justice, Bruno then went to court. The judgment rendered by the Paris judicial court on July 9, 2024 allowed Bruno, his wife and three children to obtain 2,000 euros in compensation.

Understanding your rights as a passenger #
It is essential to know your rights in the event of a flight delay. According to the article L. 211-16 of the Tourism Code, the tour operator is automatically responsible for the execution of the tourist services planned in the trip. The court recalls that “automatic liability was precisely provided for by the legislator to prevent tour operators from seeking to exempt themselves from their liability by claiming to be a simple intermediary”.
Your right to compensation in the event of delay #
If this summer your flight is more than 3 hours late, you are entitled to compensation for Article 7 of European Regulation No. 261/2004 of February 11, 2004. This compensation is calculated based on the number of kilometers and the destination (EU or outside the EU). It can vary from 250 to 600 euros.
Here are the main levels of compensation:
- 250 euros for flights of 1,500 km or less
- 400 euros for intra-EU flights over 1,500 km and all other flights between 1,500 km and 3,500 km
- 600 euros for all other flights over 3,500 km
In some cases, if the company refuses to compensate you, you can go to court to obtain more favorable compensation, although this requires more effort.
